Share Design Competitions

 

GENERAL TERMS AND CONDITIONS

 

Applicability

(a) These General Terms and Conditions apply to all Competitions conducted by Share Design during the Term.

 

(b) To the extent permitted by law, Share Design may vary the whole or any part of these General Terms and Conditions at any time without notice.

 

(c) If Share Design varies these General Terms and Conditions, they will apply as varied to Competitions commenced after the date of variation.

 

Conditions of entry

(a) Each time a person enters a Competition, they are deemed to accept these General Terms and Conditions.

 

(b) Entry into and participation in Competitions is restricted to Australian individual residents aged 18 years or older.

 

(c) Employees of Share Design and their immediate families must not enter or participate in Competitions. The suppliers and agencies associated with a Competition must not enter or participate in that Competition. 

 

(d) Entry into and participation in Competitions is free.

 

Key Dates

(a) Competitions will generally be run on a weekly basis during the Terma.

 

(b) A person may enter a Competition only during the entry period specified in the Advertisement for that Competition. The time of entry is deemed to be when Share Design receives a person’s entry, not the time it sent.

 

How to enter

(a) To enter a Competition, a person must follow the entry instructions in the Advertisement for that Competition.

 

(b) If entry into a Competition requires a person to provide information, they must provide the required information accurately and completely.

 

(c) If an entry is late, incomplete, incorrectly submitted, illegible, corrupted and/or misdirected, it is deemed to be invalid.

 

Determination of winners

(a) The winner(s) for a Competition will be determined in accordance with the procedure set out in the Advertisement for that Competition.

 

(b) If an Advertisement refers to entries being judged, they will be judged by a panel of Share Design’s staff (Judging Panel), unless otherwise specified in the Advertisement.

 

(c) The Judging Panel will review and consider each entry by reference to the judging criteria set out in the Advertisement.

 

(d) The Judging Panel will determine the winner(s) on the date specified in the Advertisement. All decisions of the Judging Panel are final and no discussions or correspondence will be entered into.

 

Winner notification

The winner(s) will be notified in by email and/or telephone within 7 days of being determined in accordance with section 5 above.

 

Prizes

(a) The prize(s) for a Competition will be as set out in the Advertisement for that Competition.

 

(b) If a prize is unavailable for any reason, Share Design reserves the right to provide a substitute prize of equal or greater value.

 

(c) If a prize is a gift card, it will be subject to the usual terms and conditions of issuer of the gift card.

 

(d) Prizes are not transferable, exchangeable or redeemable for cash. Prize values are in Australian dollars, based on recommended retail prices, include GST and are correct at time of printing. Share Design accepts no responsibility for any changes in the value of a prize. To the extent permitted by law, Share Design makes no representations or warranties about the quality, suitability or merchantability of any prizes.

 

(e) Prizes will be delivered to winners within 28 days of them being determined in accordance with section 5 above, unless otherwise agreed between Share Design and winners.

 

(f) Share Design and its associated agencies and companies will not be responsible for any damage to or loss of prizes in transit. After a prize leaves Share Design’s premises, Share Design will not be responsible for any delay in the delivery that prize.

 

Unclaimed prizes

If a prize is not claimed within 3 months after the winner is determined (despite reasonable efforts by Share Design to distribute the prize), the winner will be disqualified and a replacement winner will be determined in accordance section 5 above.

 

Miscellaneous

(a) Information in an Advertisement for a Competition forms part of these General Terms and Conditions as they apply to that Competition.

 

(b) All decisions of Share Design are final and no discussions or correspondence will be entered into. Failure by Share Design to enforce any of its rights under these General Terms and Conditions does not constitute waiver of those rights.

 

(c) Share Design reserves the right at any time to verify the validity of entries and entrants (including an entrant's identity, age, place of residence and proof of purchase).

 

(d) Share Design reserves the right to refuse to allow a winner to take part in any or all aspects of the prize if it determines in its sole discretion that a winner is not in the mental or physical condition necessary to safely participate in the prize.

 

(e) Share Design reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these General Terms and Conditions, or engaged in any unlawful or other improper conduct, including conduct calculated to jeopardise the fair and proper conduct of any Competition. Share Design’s rights to recover damages or other compensation in such cases are reserved.

 

(f) If a Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Share Design, Share Design reserves the right in its sole discretion and to the extent permitted by law, to modify, suspend, terminate or cancel that Competition.

 

(g) Except for any liability that cannot be excluded by law, Share Design (including its directors, officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of any Competition, including, but not limited to, loss or damage arising from any technical difficulties or equipment malfunction (whether or not under Share Designs’ control); any theft, unauthorised access or third party interference; or any tax liability incurred by any winners or entrants.

 

(h) By entering into and/or participating in a Competition, each entrant grants a perpetual worldwide non-exclusive royalty-free licence to Share Design to use and sub-licence the use of any copyright (including future copyright) in and to any entry submitted by such entrant and, to the extent permitted by law, waives his or her moral rights in respect of same. Each entrant warrants to Share Design that his or her entry does not infringe the intellectual property rights of any person.

 

(i) Personal information provided by entrants will be used by Share Design for the purpose of conducting this competition and otherwise in accordance with entrants’ consent. Share Design may disclose entrants’ personal information to its contractors and agents in relation to Competition, or in some cases the sponsor of the relevant Competition. Share Design’s privacy policy is available at www.sharedesign.com.

 

Definitions

Advertisement: The document or communication that is produced by Share Design and published or distributed by it for the purposes of promoting a Competition.

 

Competition: Any competition for which the determination of the winner does not involve an element of chance.

 

General Terms and Conditions: This document.

 

Judging Panel: See clause 5.
